Defense: Army violated rights in seizing general's computers

FORT BRAGG, N.C. — A U.S. Army officer admits he used what he described as ďa ruseĒ to retrieve computers from the home of a general under investigation for alleged sexual assaults.

The Fayetteville Observer reported Wednesday that Col. Mark Murray testified at a pretrial hearing in the case of Brig. Gen. Jeffrey Sinclair, who faces court-martial next month on charges including forcible sodomy, indecent acts, violating orders and adultery.

Murray testified that early in the investigation he called the generalís wife and told her the government-owned computers in their home at Fort Bragg needed to be updated. Sinclairís wife had not been told her husband, on deployment in Afghanistan, was under investigation.

Sinclairís defense team contends the computers were seized without a search warrant in violation of the generalís constitutional rights.
