Navy announces verdicts of December courts-martial

As part of a pledge in 2013 to be “active, open and transparent” when it comes to sexual assault prevention efforts, the Navy on Wednesday continued its monthly release of all courts-martial verdicts, announcing December’s results for all 24 cases, sexual assault-related and otherwise.

The service also announced an addition to the November list, which appears in full below.


December verdicts

Navy Region Mid-Atlantic

■ At a general court-martial in Norfolk, Va., EM2 Dwayne S. Drayton pleaded guilty to abusive sexual contact. On Dec. 5, the military judge sentenced him to a bad conduct discharge and confinement for 24 months.

■ At a general court-martial in Norfolk, an E-4 was tried for rape, sexual assault and unlawful entry. On Dec. 12, the panel of members returned a verdict of not guilty.

■ At a general court-martial in Norfolk, AT1 Richard Lesley was tried for possession of child pornography. On Dec. 19, the panel of members returned a verdict of guilty and sentenced him to a bad conduct discharge and confinement for 18 months.

■ At a special court-martial in Norfolk, FC2 Joshua Gibson pleaded guilty to sexual harassment and assault consummated by a battery. On Dec. 3, the military judge sentenced him to a bad conduct discharge and confinement for 75 days.

■ At a special court-martial in Norfolk, HM3 Christopher Barnes pleaded guilty to assault consummated by a battery. On Dec. 19, the military judge sentenced him to reduction in rank to E-1 and confinement for 60 days.

Navy Region Southeast

■ At a general court-martial in Mayport, Fla., an E-4 was tried for aggravated sexual assault. On Dec. 11, the military judge returned a verdict of not guilty

■ At a general court-martial in Jacksonville, Fla., QM3 Jason J. Carchio pleaded guilty to misuse of a government computer, indecent communications to a minor, and solicitation, distribution and possession of child pornography. On Dec. 12, the military judge sentenced him to a dishonorable discharge, the forfeiture of all pay and allowances, reduction in rank to E-1, a fine of $5,000, and confinement for 30 months.

■ At a general court-martial in Mayport, CS3 Michael A. Rivas pleaded guilty to rape. On Dec. 19, the military judge sentenced him to a dishonorable discharge, reduction in rank to E-1 and confinement for four years.

■ At a special court-martial in Pensacola, Fla., BM1 Billy L. Slankard III pleaded guilty to assault. On Dec. 17, the military judge sentenced him to a reprimand, the forfeiture of $500 per month for three months and restriction for 60 days.

■ At a special court-martial in Pensacola, MMC Joshua A. Marquez pleaded guilty to assault consummated by a battery and fraternization. On Dec. 18, the military judge sentenced him to a reprimand, reduction in rank to E-6 and confinement for 75 days.

■ At a special court-martial in Jacksonville, MT3 Nathaniel A. Camacho pleaded guilty to attempting to contribute to the delinquency of a minor. On Dec. 30, the military judge sentenced him to forfeit $500 per month for three months, reduction in rank to E-2, a fine of $1,500, confinement for 30 days, and confinement for an additional 30 days in the event of nonpayment of the fine.

Navy Region Midwest

■ At a special court-martial in Great Lakes, Ill., PR1 John E. Beach pleaded guilty to assault consummated by a battery. On Dec. 13, the military judge sentenced him to a bad conduct discharge reduction in rank to E-5 and confinement for 270 days.

Navy Region Northwest

■ At a general court-martial in Bremerton, Wash., ET2 Christopher J. Schaleger pleaded guilty to sexual assault. On Dec. 16, the military judge sentenced him to a bad conduct discharge, reduction in rank to E-1 and confinement for three years.

■ At a special court-martial in Bremerton, YN3 Jose R. Mismith pleaded guilty to assaults consummated by battery. On Dec. 13, the military judge sentenced him to reduction in rank to E-2 and confinement for 85 days.

■ At a special court-martial in Bremerton, CS3 Wyman A. Henry pleaded guilty to sexual assault. On Dec. 18, the military judge sentenced him to reduction in rank to E-2 and confinement for 60 days.

Navy Region Southwest

■ At a general court-martial in San Diego, ABF2 Jabian D. Viltz pleaded guilty to violation of a lawful general regulation and abusive sexual contact. On Dec. 9, the military judge sentenced him to be discharged with a Bad Conduct Discharge and confinement for 22 months.

■ At a special court-martial in Lemoore, Calif., an E-6 was tried for violation of a lawful general regulation, maltreatment, assault and obstruction. On Dec. 5, a panel of members returned a verdict of not guilty to all charges and specifications.

■ At a special court-martial in San Diego, HM1 Thomas M. Turman pleaded guilty to violation of a lawful general regulation, false official statement and wrongful appropriation. On Dec. 12, the military judge sentenced to a bad conduct discharge, reduction in rank to E-1 and confinement for six months.

■ At a special court-martial in San Diego, ABH1 Erwin G. Martin pleaded guilty to making a false official statement. On Dec. 18, the military judge sentenced him to a reprimand, reduction in rank to E-5, restriction for 30 days, and 30 days hard labor without confinement.

■ At a special court-martial in San Diego, GSMFR Brandon M. McClain pleaded guilty to wrongful use of a controlled substance and breaking restriction. On Dec. 19, the military judge sentenced him to a bad conduct discharge and confinement for 90 days.

Navy Region Hawaii

■ At a general court-martial in Pearl Harbor, Hawaii, MR3 Christopher Shafer pleaded guilty to receipt and possession of child pornography. On Dec. 21, the military judge sentenced him to a bad conduct discharge, the forfeiture of all pay and allowances, reduction in rank to E-1 and confinement for 300 days.

■ At a special court-martial in Pearl Harbor, GM3 Rudy Orozco pleaded guilty to abusive sexual contact. On Dec. 18, the military judge sentenced him to a bad conduct discharge, reduction in rank to E-1 and confinement for 90 days.

Navy Region Europe, Africa, Southwest Asia

■ At a general court-martial in Bahrain, QM3 Marshe McNeal pleaded guilty to wrongful appropriation, reckless operation of a vehicle, and drunk and disorderly conduct. On Dec. 3, the military judge sentenced her to a bad conduct discharge reduction in rank to E-1 and confinement for 14 months.

■ At a general court-martial in Naples, Italy, IT2 Jacob Pease was tried for sexual assault and violation of a lawful general order. On Dec. 13, the panel of members returned a verdict of guilty to all charges and sentenced him to a dishonorable discharge and confinement for six years.


November verdicts

Navy Region Mid-Atlantic

■ At a general court-martial in Norfolk, Va., CSC Gerald J. Currie pleaded guilty to three specifications of false official statement and one specification of larceny of military property at a value greater than $500. On Nov. 6, a panel of members sentenced him to reduction in rank to E-5, a fine of $10,000 and confinement for 45 days.

■ At a general court-martial in Norfolk, an E-4 was tried for abusive sexual contact. On Nov. 14, a panel of members returned a verdict of not guilty.

■ At a general court-martial in Norfolk, AN Axel H. Gutierrez pleaded guilty to assault consummated by a battery. On Nov. 21, the military judge sentenced him to a bad conduct discharge, forfeiture of all pay and allowances, reduction in rank to E-1 and confinement for five months.

■ At a special court-martial in Norfolk, LSSA Derek J. Wolski pleaded guilty to wrongful use of a controlled substance, larceny of military property of a value greater than $500 and wrongful communication of a threat. On Nov. 1, the military judge sentenced him to a bad-conduct discharge, a fine of $850 and confinement for five months.

■ At a special court-martial in Norfolk, FCC Christopher Johnson pleaded guilty to fraternization. On Nov. 4, the military judge sentenced him to reduction in rank to E-5 and 30 days confinement.

■ At a special court-martial in Norfolk, EN1 Stevenson B. Anderson pleaded guilty to sexual harassment and assault upon a petty officer. On Nov. 5, the military judge sentenced him to reduction in rank to E-4, 35 days restriction and confinement for 14 days.

■ At a special court-martial in Norfolk, Va., BMC Andrew L. Pierce pleaded guilty to sexual harassment and assault consummated by a battery. On Nov. 14, the military judge sentenced him to reduction in rank to E-6, hard labor without confinement for 14 days and confinement for 30 days.

■ At a special court-martial in Norfolk, Va., an E-4 was tried for abusive sexual contact. On Nov. 14, a panel of members returned a verdict of not guilty.

Navy Region Southeast

■ At a general court-martial in Pensacola, Fla., an E-4 was tried for two specifications of aggravated sexual assault. On Nov. 15, a panel of members returned a verdict of not guilty.

■ At a special court-martial in Jacksonville, Fla., AE3 Shawn Dengler pleaded guilty to violation of lawful general order, wrongful use of a synthetic cannabinoid, assault consummated by a battery and communicating a threat. On Nov. 5, the military judge sentenced him to a bad conduct discharge, reduction in rank to E-2 and confinement for 120 days.

■ At a special court-martial in Mayport, Fla., HMC Richard Donahue III pleaded guilty to wrongful possession of a controlled substance, larceny, housebreaking and solicitation to commit larceny. On Nov. 20, the military judge sentenced him to a reprimand, a fine of $2,000 and confinement for 45 days.

Navy Region Midwest

■ At a general court-martial in Great Lakes, Ill., EMFA Ryan Hintze pleaded guilty to orders violations, false official statements, abusive sexual contacts and bribery. On Nov. 7, the military judge sentenced him to a dishonorable discharge, reduction in rank to E-1 and confinement for four years.

Navy Region Northwest

■ At a general court-martial in Everett, Wash., an E-4 was tried for forcible rape and sexual assault. On Nov. 13, the military judge returned a verdict of not guilty.

■ At a special court-martial in Bremerton, Wash., AS1 Angelo Raul R. Casa pleaded guilty to unauthorized absence, fraternization, and larceny. On Nov. 8, the military judge sentenced him to a bad conduct discharge, reduction in rank to E-1, forfeiture of $1,000 per month for 12 months, and confinement for 350 days.

■ At a special court-martial in Bremerton, MA2 Vonterio T. Wainwright pleaded guilty to violating a lawful order and larceny. On Nov. 21, the military judge sentenced him to reduction in rank to E-3, forfeiture of $1,000 per month for five months, a fine of $2,000 and confinement for 85 days.

■ At a special court-martial in Everett, Wash., AWO2 Thor Z. Watts pleaded guilty to assault consummated by a battery, carrying a concealed weapon, reckless endangerment and drunk and disorderly conduct. On Nov. 25, the military judge sentenced him to a bad conduct discharge, reduction in rank to E-1, forfeiture of $1,000 per month for 10 months and confinement for 10 months.

Navy Region Southwest

■ At a special court-martial in Lemoore, Calif., LS1 O’Neil S. Gordon was tried for failure to obey a lawful general order. On Nov. 20, the military judge returned a verdict of guilty and sentenced him to forfeit $1,000 per month for two months.

■ At a special court-martial in San Diego, CSSN Titus R. Mayo Jr. pleaded guilty to absence without leave, missing movement, disrespect towards a superior commissioned officer, false official statements, wrongful use of a controlled substance, larceny and wrongful cohabitation. On Nov. 25, the military judge sentenced him to a bad conduct discharge, reduction in rank to E-1 and confinement for 200 days.

■ At a special court-martial in San Diego, CSSN Taylor M. Brown pleaded guilty to absence without leave, failure to obey a lawful general order, larceny, wrongful marriage and wrongfully subscribing as true a materially false statement. On Nov. 27, the military judge sentenced him to a bad conduct discharge, a fine of $3,000 and confinement for nine months.

Navy Region Hawaii

■ At a general court-martial in Pearl Harbor, Hawaii, an E-4 was tried for attempted rape, attempted abusive sexual contact, aggravated sexual contact and abusive sexual contact. On Nov. 21, the panel of members returned a verdict of not guilty. This court-martial was omitted from the Navy’s original November list and included on its December report.

Navy Region Japan

■ At a general court-martial in Yokosuka, Japan, an E-4 was tried for two specifications of sexual assault. On Nov. 18, a panel of members, including enlisted personnel, returned a verdict of not guilty.

■ At a special court-martial in Yokosuka, STGCM Michael Walker pleaded guilty to violation of a lawful general order, false official statement and assault consummated by a battery. On Nov. 7, the military judge sentenced him to a bad conduct discharge, reduction in rank to E-3, a reprimand and confinement for 270 days.

■ At a special court-martial in Yokosuka, NCCS Steven Smith pleaded guilty to violation of a lawful general order. On Nov. 21, the military judge sentenced him to reduction in rank to E-5, a fine of $8,000, a reprimand and confinement for 89 days.

■ At a special court-martial in Yokosuka, MA2 Sean Bernstein pleaded guilty to violation of a lawful general order and a false official statement. On Nov. 21, the military judge sentenced him to a bad conduct discharge, reduction in rank to E-1 and confinement for 53 days.
